Drug Possession Charge Finalised Without Conviction at Burwood Local Court

Outcome: CRO Without Conviction | No Criminal Record | Drug Possession | MDMA

Our client was a 24-year-old woman from Strathfield, NSW. She was employed full-time as a registered nurse, had no criminal history, and had never previously been required to attend court.

While attending a music festival at Sydney Olympic Park, our client was approached by police after a drug detection dog indicated an interest in her. During a search, police located MDMA on her person. She cooperated with police and made admissions at the scene.

Our client was charged with possessing a prohibited drug under section 10 of the Drug Misuse and Trafficking Act 1985 (NSW), which carries a maximum penalty of 20 penalty units, two years’ imprisonment, or both.

She contacted Rezae & Co Lawyers because a conviction carried real consequences for her – not just a fine or a record, but a direct threat to her professional registration as a nurse and her ability to continue working in healthcare. We obtained her instructions, reviewed the police material and advised her about an early plea, the sentencing process and the prospects of a non-conviction outcome.

Before sentence, our defence team prepared written submissions, character references, evidence of stable employment and material confirming completion of drug education and counselling. We submitted that the offending was isolated and out of character, that our client had excellent prospects of rehabilitation, and that the arrest and court process had already achieved specific deterrence.

The Court accepted our submissions and imposed a conditional release order without proceeding to conviction. Our client finalised the matter without a conviction being recorded, protecting her nursing registration and her career.

Outcome: Conditional Release Order without conviction. No criminal record recorded.
